Agreement to Terms
By accessing dustinkain.com or purchasing any product or service from DK Studio, you agree to be bound by these Terms of Service. If you do not agree, please do not use this site or make any purchases.
About DK Studio
DK Studio is a freelance design, illustration, and web development studio operated by Dustin Kain, based in Fort Lauderdale, Florida. Services include brand identity design, web development, illustration, print design, apparel, and digital products.
Intellectual Property
All original artwork, designs, illustrations, logos, and creative work produced by DK Studio remains the intellectual property of Dustin Kain unless explicitly transferred in writing as part of a client agreement.
- Client work: Full usage rights are granted upon final payment for the agreed deliverables. Transfer of ownership rights requires a separate written agreement.
- Shop products: All apparel designs and digital prints are original works. Purchasing a product grants personal use rights only — not the right to reproduce, resell, or distribute the artwork.
- Portfolio: Work shown in the portfolio remains the property of DK Studio or respective clients and may not be reproduced without written permission.
Prohibited Uses
You may not use any content from this site to train AI models, scrape for commercial data collection, reproduce or resell original artwork, or misrepresent work as your own.
Limitation of Liability
DK Studio is not liable for indirect, incidental, or consequential damages arising from the use of this website or any products or services purchased. Our total liability shall not exceed the amount paid for the specific product or service in question.
Governing Law
These terms are governed by the laws of the State of Florida, United States. Any disputes shall be resolved in the courts of Broward County, Florida.

Summary: Physical apparel may be exchanged for sizing issues. Digital products are non-refundable once delivered. Custom commission work follows a milestone-based agreement.
Physical Apparel
If you receive a defective or incorrect item, contact us within 7 days of delivery at contact@dustinkaindzn.com with your order number and a photo of the issue. We will arrange an exchange or replacement at no additional cost.
We do not accept returns for sizing preferences. Please review sizing information carefully before purchasing. Size exchanges may be accommodated on a case-by-case basis depending on available stock.
Digital Products
All digital product sales are final and non-refundable. Because digital files are delivered electronically and can be accessed immediately upon delivery, we cannot offer refunds once the download link has been sent.
- If your download link is broken or the file is corrupted, contact us immediately and we will resend it.
- If you have not received your download link within 24 hours of purchase, contact us with your order confirmation.
- Disputes filed with your bank or card issuer for digital products after download delivery will be contested with evidence of delivery.
Commission Work
Custom commission projects follow a separate agreement outlined in your project contract. Generally:
- Deposits (typically 50%) are non-refundable once work has begun.
- If a project is cancelled by the client before completion, work completed to that point may be invoiced.
- If a project is cancelled by DK Studio, any unused portion of the deposit will be returned.
How to Request a Refund or Exchange
Email contact@dustinkaindzn.com with your order number, the item in question, and a brief description of the issue. We aim to respond within 2 business days.
Important: Digital products are for personal use only. Purchasing a digital print does not transfer copyright or grant commercial use rights.
What You Receive
Upon successful payment, you will receive an email with a secure download link for your purchased file(s). Links are typically delivered within minutes and expire after 48 hours — contact us if you need the link resent.
- Files are delivered as high-resolution JPG or PNG (minimum 3000px on the longest edge)
- Files are print-ready at standard home and professional print sizes
- Color profiles are sRGB for accurate screen and print reproduction
License & Permitted Uses
Purchasing a digital print grants you a personal, non-exclusive, non-transferable license to:
- Print the file for personal display in your home or workspace
- Use as a personal device wallpaper or screensaver
- Gift a printed copy to an individual (not for resale)
Prohibited Uses
You may not:
- Resell, redistribute, or sublicense the digital file
- Print and sell copies of the artwork
- Use the artwork commercially — on products, merchandise, advertising, or social media for commercial purposes
- Claim the artwork as your own or remove watermarks or signatures
- Use the artwork to train AI models

No Refunds on Digital Products
As stated in our Refund Policy, all digital product sales are final. By completing checkout for a digital product, you acknowledge and agree to this policy.
Copyright Notice
All digital artwork is protected under U.S. and international copyright law. Unauthorized reproduction or distribution constitutes copyright infringement and may result in legal action.
Commission Inquiries
Commission availability varies. Submit an inquiry through the contact form or email contact@dustinkaindzn.com with a description of your project, timeline, and budget. Not all inquiries will be accepted — project fit and schedule are considered.
Project Agreement
All commission work begins with a written agreement outlining scope, deliverables, timeline, payment schedule, and revision rounds. Work does not begin until the agreement is signed and the deposit is received.
Revisions
Each project includes a set number of revision rounds as specified in your agreement. Revisions beyond the included rounds are billed at an hourly rate or a flat revision fee, agreed upon in advance.
Ownership & Usage Rights
Final deliverables are released to the client upon receipt of final payment. The specific rights transferred (usage rights, full ownership, exclusivity) are defined in the project agreement. DK Studio reserves the right to display completed work in the portfolio unless a confidentiality clause is agreed upon.
Timeline & Rush Fees
Standard timelines are estimated in the project agreement. Rush projects (requiring turnaround faster than the standard timeline) may incur an additional fee of 25–50% of the project rate, agreed upon before work begins.
